Privacy Policy

At Beyond Limits Assistance, we respect your privacy and are committed to handling personal information in a careful, respectful and transparent way.

This Privacy Policy explains how we collect, hold, use and disclose personal information, how you can access or correct your information, and how you can make a privacy complaint.

As a disability service provider, we may handle health information as part of providing support services. Under Australian privacy law, organisations that provide a health service and hold health information are covered by the Privacy Act 1988 (Cth), including disability service providers where they handle health information.

What personal information we collect

The personal information we collect depends on how you interact with us, but may include:

  • your name
  • phone number
  • email address
  • suburb or location
  • details about the supports you are looking for
  • information included in messages, enquiries or referrals
  • participant details provided in a referral
  • referrer details, including role and contact information
  • consent or authority details provided with a referral
  • other information reasonably necessary for us to respond to an enquiry, consider a referral, arrange supports, communicate with you, or provide services.

In some cases, this may include sensitive information, such as information about a person’s disability, health, support needs, or related circumstances. Australian privacy law gives sensitive and health information a higher level of protection.

How we collect personal information

We generally collect personal information directly from you when you:

  • call us
  • email us
  • submit a contact form
  • submit an enquiry form
  • submit a referral form
  • communicate with us about supports or services.

We may also collect personal information from a parent, family member, carer, guardian, nominee, support coordinator, allied health provider, hospital or discharge planner, or another authorised representative where they contact us on your behalf or submit a referral. Our referral form currently requires the referrer to confirm that they have the participant’s consent, or appropriate authority, to share the information for arranging support.

Where reasonable and practicable, we will collect personal information directly from the person concerned.

Why we collect, use and disclose personal information

We collect, use and disclose personal information so we can:

  • respond to enquiries and contact requests
  • assess whether our services are suitable
  • process and respond to referrals
  • communicate about supports, availability and next steps
  • provide disability support services
  • manage service delivery and related administration
  • keep records required for operational, legal and compliance purposes
  • protect the safety, rights and wellbeing of participants, staff and others
  • comply with applicable legal, regulatory, safeguarding and reporting obligations.

Australian privacy law generally requires personal information to be used or disclosed for the purpose for which it was collected, unless consent is given or another legal exception applies.

Sensitive information

Where we collect sensitive information, including health or disability-related information, we will only do so where it is reasonably necessary for our functions or activities and where permitted by law, including with consent where required.

If you provide us with sensitive information about another person, you should only do so if you are authorised to share it with us.

Website enquiries and referrals

Our website currently includes a contact form, an enquiry form and a referral form. These forms ask for personal details so we can respond to your message, understand the support requested, identify who to contact, and take the next step with you. The contact page also states that details submitted through that form are used to respond to the message.

Please avoid sending more personal or sensitive information than is necessary in a general website enquiry. Where detailed or sensitive service information is needed, we may contact you to continue the conversation in a more appropriate way.

Direct marketing

We may contact you about your enquiry, referral, supports or services. If we send direct marketing communications, we will do so in accordance with applicable privacy laws and you may ask us to stop at any time. Sensitive information must not be used for direct marketing unless consent is given.

To opt out of marketing communications, please contact us using the details below.

Disclosure of personal information

Depending on the circumstances, we may disclose personal information to:

  • the person the information relates to
  • family members, carers, guardians, nominees or authorised representatives
  • support coordinators, plan managers or referrers
  • service providers or contractors who help us operate our business or website
  • professional advisers
  • regulators, government bodies, law enforcement, safeguarding bodies or complaint authorities where required or authorised by law
  • other parties where you have asked us to, authorised us to, or consented to the disclosure.

We take reasonable steps to ensure that disclosures are limited to what is appropriate in the circumstances.

Overseas disclosure

Some third-party service providers we use to help operate our website, communications or systems may store or process personal information outside Australia.

If we disclose personal information to an overseas recipient, we will take reasonable steps required under Australian privacy law before doing so.

Data quality

We take reasonable steps to ensure that the personal information we collect, use and disclose is accurate, up to date, complete and relevant for the purpose for which it is held. Please let us know if your details change or if you believe any information we hold is incorrect.

Storage and security

We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps may include secure systems, restricted access, staff confidentiality measures, secure communication practices, and secure destruction or de-identification when information is no longer required and we are permitted to do so.

Because health and other sensitive information requires a higher level of protection, we take extra care with that information.

Data breaches

If a data breach affecting personal information occurs, we will respond in line with our legal obligations. Where the Privacy Act and Notifiable Data Breaches scheme apply and a breach is likely to result in serious harm, affected individuals and the OAIC must be notified.

Access to and correction of personal information

You may request access to the personal information we hold about you, and you may ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading. We will respond to your request within a reasonable time and in accordance with Australian privacy law.

To request access or correction, please contact us using the details below.

Anonymity and pseudonyms

Where lawful and practical, you may be able to deal with us anonymously or by using a pseudonym for a general enquiry. However, in many cases we will need your identity and contact details to respond to an enquiry, process a referral, arrange supports, provide services, or comply with legal obligations.

Making a privacy complaint

If you have a concern about how we have handled your personal information, please contact us in writing using the details below and explain the issue.

We will review your complaint and respond within a reasonable period.

If you are not satisfied with our response, or we do not respond within a reasonable time, you may be able to lodge a complaint with the Office of the Australian Information Commissioner (OAIC). The OAIC says people should generally complain to the organisation first and allow about 30 days for a response before escalating the matter.
